Please read these Terms and Conditions (“Terms”, “Terms of Use and Conditions”) carefully before using the https://www.untangledadhd.com website (the “Service”), buying our products (the “Service”), using our social medias (the “Service”) and/or starting our coaching services (the “Service”) operated by Untangled ADHD / Ana Paula Francisco (“us”, “we”, or “our”). Your access to and use of the Service is conditioned to your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms, and to the collection and/or use of information in accordance with this policy. If you disagree with any part of the Terms then you may not access the Service.

  • Coaching Service Agreement: All enrollments and appointments are offered on a first come, first served basis.  Clients can make their own appointments online for up to 180 days before their requested time.

 

  • Coaching Reports: You will always receive a very thorough verbal report as part of the assessment and coaching process. If you need a written report the cost is $300 USD. The payment needs to be made in advance. After the payment is completed, it may take up to 30 days for the written report to be delivered. If you need a written report, please send an email to ana@untangledadhd.com.

 

  • Privacy: Your use of untangledadhd.com and its services is subject to its privacy policy. Please review our Privacy Policy, which also governs the Site and Services and informs users of our data collection practices. 

 

  • Electronic Communications: Visiting untangledadhd.com, or sending emails to us constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the website, satisfy any legal requirement that such communications be in writing. Also, once you are enrolled in any of our coaching services, communication will be done thought email. In doing so, you consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the website, satisfy any legal requirement that such communications be in writing. It is your responsibility to keep us updated with any changes to your email address while enrolled on our coaching services.

 

  • Links to third party sites/Third party services: The Site our blog and social medias may contain links to other websites (“Linked Sites”). During our coaching services you may also receive suggestions of website links. The Linked Sites are not under the control of Untangled ADHD / Ana Paula Francisco and we are not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked or suggested Site, or any changes or updates to a Linked or suggested Site. We are providing these links and suggestions to you only as a convenience, and the inclusion of any link or suggested Site does not imply endorsement of the website by Ana Paula Francisco or any association with its operators. If there is any association, it will be disclosed in the link. We advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. Certain services made available via untangledadhd.com and our coaching services are delivered by third party sites and organizations. By using any product, service or functionality originating from the www.untangledadhd.com domain, you hereby acknowledge and consent that Ana Paula Francisco may share such information and data with any third party with whom Ana Paula Francisco has a contractual relationship to provide the requested product, service or functionality on behalf of www.untangledadhd.com users and customers. 

 

  • Termination in case of harassment or discrimination: We do not tolerate harassment or discrimination of any kind. Which includes harassment or discrimination directly towards Ana Paula Francisco or to any other participant on the coaching services during group appointments, or participants in our social medias. Any case of harassment or discrimination will result in suspension from our services without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. No refunds will be made in this case.

Unwanted texting, calling, emailing, following, stalking, badgering, intimidating, threatening, or otherwise making oneself impossible to disengage from will result in suspension from our services without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. No refunds will be made in this case.

Harassment means a course of comments or actions that are known, or ought reasonably to be known, to be unwelcome. It can involve words or actions that are known, or should be known, to be offensive, embarrassing, humiliating, demeaning or unwelcome, based on a ground of discrimination. Harassment can occur based on any of the grounds of discrimination. If a person does not explicitly object to harassing behaviour, or appears to be going along with it, this does not mean that the behaviour is acceptable. The behaviour could still be considered harassment.

 

Examples of harassment include:

  • Epithets, remarks, jokes or innuendos related to a person’s race, gender identity, gender expression, sex, disability, sexual orientation, creed, age, or any other ground;
  • Posting or circulating offensive pictures, graffiti, or materials, whether in print form or via e-mail or other electronic means;
  • Singling out a person for humiliating or demeaning teasing or jokes;
  • Comments ridiculing a person because of characteristics that are related to a ground of discrimination. For example, this could include comments about a person’s dress, speech, or other practices that may be related to their sex, race, gender identity, or creed.

 

Sexual and gender-based harassment: sexual harassment is a form of harassment that can include:

  • Gender-related comments about a person’s physical characteristics or mannerisms;
  • Paternalism based on gender which a person feels undermines their self-respect or position of responsibility;
  • Unwelcome physical contact;
  • Suggestive or offensive remarks or innuendoes about members of a specific gender;
  • Propositions of physical intimacy;
  • Gender-related verbal abuse, threats, or taunting;
  • Leering or inappropriate staring;
  • Bragging about sexual prowess or questions or discussions about sexual activities;
  • Offensive jokes or comments of a sexual nature about an employee or client
  • Rough and vulgar humor or language related to gender;
  • Display of sexually offensive pictures, graffiti or other materials including through electronic means;
  • Demands for dates or sexual favors.

 

  • Unsubscribe: If at any time you would like to unsubscribe from receiving future emails, we include the one-step instructions to cancel your subscription in each email. If you do not want to receive emails during the coaching process you also need to inform about it.
  • Text message: You agree to receive a text message with a reminder for your appointment on the cellphone number provided during the payment and scheduling process. If you do not agree with to receive it, you need to contact us by email to ana@untangledadhd.com and inform us.
  • Accessing and changing your information: You can review the personal information you provided us and make any desired changes to such information at any time through email request to ana@untangled.com. At the time of your request, we may need further information from you to verify your identity before we will provide access to your information.

  • Coach-Client Relationship: Once there is a coach-client relationship, after you opted to start the coaching meetings, you, as the client, understand and agree with the following statements:

 

  • The coaching relationship is a partnership between two or more individuals or entities. This relationship is not a legal partnership, instead more like a teacher-student or coach-athlete relationship. Each party must uphold their obligations for the coaching relationship to be successful.

 

  • The coach will/will not be available by telephone and/or email in between scheduled sessions and scheduled check-in emails.

 

  • The client acknowledges and agrees that coaching is a comprehensive process that may explore different areas of his/her life, including work, finances, health and relationships, but it is ultimately the client’s decision how he/she incorporates coaching into each aspect of life.

 

  • The client is solely responsible for implementing the techniques discovered through coaching. Coaching is not a therapeutic relationship or a medical one. The coach may not provide therapy or medical services and client is responsible for procuring these services at client’s own will and discretion if needed. The coach will maintain communications, documents, information, and notes related to client coaching, in the most convenient way for the coach for ten years.
  • The client is solely responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and their coaching calls and interactions with the coach. As such, the client agrees that the coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the coach. The client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
  • The client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.
  • The client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical, or other qualified professionals and that it is the client’s exclusive responsibility to seek such independent professional guidance as needed. If the client is currently under the care of a mental health professional, it is recommended that the client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the client and the coach.
  • The client understands that in order to enhance the coaching relationship, the client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.
  • It is also important to note that in some situations, it is important to be aware of the use of technology and the fact that there is a risk in using certain media such as the internet, mobile phones and cordless phones for communication. If you use these to communicate with us, then we will assume that it is appropriate to continue to do so in my interactions with you. Since the coaching service are provided through the internet (i.e. Zoom, Skype, email) and/or mobile phones, once you pay for the coaching meetings you are agreeing to use these methods to communicate with us. If for some reason you do not agree in using these to communicate, please do not start using our coaching services.

 

  • Confidentiality on the coaching service: This coaching relationship, as well as all information (documented or verbal) that the client shares with the coach as part of this relationship, is bound by the principles of confidentiality. However, please be aware that the coach-client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The coach agrees not to disclose any information pertaining to the client without the client’s written consent. The coach will not disclose the client’s name as a reference without the client’s consent. Confidential Information does not include information that: (a) was in the coach’s possession prior to its being furnished by the client; (b) is generally known to the public or in the client’s industry; (c) is obtained by the coach from a third party, without breach of any obligation to the client; (d) is independently developed by the coach without use of or reference to the client’s confidential information; or (e) the coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the coach and as a result of such disclosure the coach reasonably believes there to be an imminent or likely risk of danger or harm to the client or others; and (g) involves illegal activity. The client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

 

  • Limitation of Liability: You agree to absolve Untangled ADHD / Ana Paula Francisco  of any and all liability or loss that you or any person or entity associated with you may suffer or incur as a result of use of the information contained on this website, our social medias, the coaching service, and/or the resources you may download from this website and our social medias.  You agree that the company shall not be liable to you for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for use of this website, our social medias and the coaching service.

 

The information, software, products, and services included in or available through the website may include inaccuracies or typographical errors. Changes are periodically added to the information herein. The company and/or its suppliers may make improvements and/or changes in the website, our social medias, coaching services and other products at any time.
